FAQ
- Why did Digital Railroad have to close? In spite of efforts to find additional funding or a strategic partner Digital Railroad (“DRR”) was unable to attract the necessary capital to sustain operations. All employees were terminated and DRR defaulted on its loan agreement with the senior secured creditor. Subsequently DRR entered into a peaceful foreclosure with the senior creditor, who took possession of DRR’s assets that included all equipment necessary to operate the DRR website.
- I wish to recover my images stored on the Digital Railroad servers. How can this be accomplished? The images have been destroyed, recovery of your images is not possible.
- What assurance do I have that the copyrighted images on the servers will be scrubbed clean and the data will be unrecoverable? No one outside of DRR knows how the image storage technology was implemented. The images are not stored on hard drives like you have on your home computer. In this case each image is mirrored and striped across hundreds of disks, once the delete scripts start to run it will delete all data and restripe the clusters, wiping out any way to recover a whole image even using data recovery tools. In addition the individual drives will be swapped within the system. This will break the cluster making it impossible to run without reinstalling the OS. Reinstalling the OS will require that each disk be reformatted, thereby guaranteeing that the images are unrecoverable.
- I have paid an annual fee for hosting services and these services were terminated before the year was completed. Will I get a refund? No, the company lacks the cash necessary to refund payments or pay any unsecured creditor.
- I am a photographer whose images have been used by a publisher and I know that the publisher paid Digital Railroad for the use of my images. Digital Railroad has not paid me for my images. When will I get paid? No, the company lacks the cash necessary to refund payments or pay any unsecured creditor.
- I have used images from the Digital Railroad site and need to be invoiced so that I can pay for their use. Will you be sending me an invoice? Yes, Digital Railroad will invoice you, collect the fees and then forward to the photographer 70% of the proceeds. This program will terminate on December 19, 2008.
- I was invoiced by Digital Railroad for the use of images. Should I pay Digital Railroad or pay the owner of the images directly? Prior to November 14, 2008, that portion of the photographer’s money collected by Digital Railroad was either, paid to the photographers, used for operating costs, or foreclosed on by the senior secured creditor. However, all monies collected after November 14, 2008, will be distributed as follows: 70% to the owners of the copyrighted material and 30% to the senior secured creditor. This program will terminate on December 19, 2008.
- I downloaded images off of the Digital Railroad site and paid Digital Railroad for their use. Now I understand that the owner of the images has not been paid by Digital Railroad. What action do we need to take regarding these images? The company lacks the cash necessary to refund payments or pay any unsecured creditor. You should contact the owner and determine how best to resolve this issue.
